CASBAA Sports TV Forum sets the pace for China

Hong Kong, September 10, 2007 – The potential business opportunities for sports television in China were highlighted during the August 24th CASBAA Sports TV Forum in Beijing.

With the theme “All-win with the Olympics”, the Forum was hosted by the State Administration of Radio, Film & Television (SARFT) and co-organized by the Cable & Satellite Broadcasting Association of Asia (CASBAA) and China International Television Corporation (CITVC), the commercial arm of state broadcaster CCTV.

Over 300 representatives of Chinese and European sports bodies, along with global sports TV networks and sports management teams participated in the Forum, exchanging insights on how sports TV can benefit the broadcasting industry and economic development within China, as well as the synergies between sports leagues and pay-TV.

With speakers drawn from the Beijing Olympic Broadcasting, SARFT, CCTV and CITVC, the Forum was keynoted by Jiang Heping, Managing Director of CCTV Sports Centre, followed by Jiang Xiaoyu, Executive Vice President of the Beijing Organizing Committee for the Games of the XXIX Olympiad (BOCOG), Lee Won-Kun, Executive Vice President of KBS of Korea, Zhou Yi, General Manager of Office of Olympic Affairs of China Mobile and Richard Dorfman, General Manager of the Department of Media and Broadcast of A1 GP.

“The broadcasts of Beijing 2008 Olympics will be the first time for many people around the globe to see modern China and much better understand the country, its people and its culture,” said Simon Twiston Davies, Chief Executive Officer of CASBAA.

“There is no doubt that the broadcasting industry is a strong platform for any company to build brand awareness and reach the target audience in a short time. We believe the demand for expanded Olympics coverage will drive demand for pay-TV and serve as a launch pad for the industry.”

At the conclusion of the Forum, Marcel Fenez, the Chairman of CASBAA, thanked organizer CITVC as well as the official Host, SARFT.

“We wish the Games a great success in China. Through our third annual forum, we hope to further promote the sports TV industry, creating a win-win situation for both the TV sector and other business opportunities in China, such as building up the brand awareness for overseas sports leagues and creating a new brand of sports product in China market,” said Fenez.

CASBAA launches Rugby World Cup Campaign

Hong Kong, September 6th, 2007 – With the up-coming launch of the Rugby World Cup competition and the opening of the English Premier League football season in August, the Cable & Satellite Broadcasting Association of Asia (CASBAA) is distributing a new round of 300 letters of awareness to Hong Kong bars, clubs and other public venues reminding them to respect pay-TV content copyright and the seriousness of engaging in satellite TV signal piracy.

The “awareness” letters further encouraged the bars to subscribe to pay-TV services through Hong Kong’s three fully-licensed pay-TV operators: Hong Kong Cable, now TV and TVB Pay Vision. Print advertisements were also placed in key newspapers and magazines to further increase public awareness.

The unauthorized commercial display in Hong Kong bars, clubs and other public venues of pay-TV programming intended for other markets, as well as trading in pirated television decoders, are acts of copyright infringement.

World Cup soccer organiser FIFA and pay-TV operators filed lawsuits against a number of Hong Kong bars for illegal broadcasting the World Cup football tournament in June of last year, resulting in six-figure settlement payments for copyright infringement along with public apologies.

CASBAA, which represents the interests of the pay-TV industry across Asia, promotes the protection of the IPR of TV content creators and distributors, including licensed sports TV programming.

“The pay-TV industry will continue to take necessary legal action against pay-TV content copyright and illegal TV signal broadcast violators,” said Mr. Simon Twiston Davies, CEO of CASBAA. “We, as an industry are committed to protecting the copyright of TV content and the interests of authorised pay-TV distributors not only in Hong Kong but across the entire region. We urge Hong Kong bars, clubs and other public venues to subscribe to licensed pay-TV programming from authorised pay-TV operators.”

CASBAA scores bar victory

Hong Kong, August 15th, 2007 – Three Hong Kong bars have settled substantial High Court lawsuits for illegally broadcasting the World Cup football tournament in June last year.

The three Wanchai bars – Carnegies, the Bridge and the Coyote Bar & Grill – made “out of court” settlements with the Federation Internationale de Football Association (FIFA) and local pay-TV operator Hong Kong Cable Television Limited (Cable TV). The defendants have paid substantial compensation to the plaintiffs for infringing copyright, covering the plaintiff’s legal costs and the placement of apology letters.

Meanwhile, two additional Hong Kong bars, The White Stag and Devil’s Advocate, still have outstanding copyright claims against them.

Speaking on behalf of the plaintiffs, the Cable & Satellite Broadcasting Association of Asia (CASBAA) welcomed the decision.

“The Hong Kong courts have once again emphasized the importance of intellectual property laws for broadcasters and the community at large. We certainly hope this message is clearly received and there is a full understanding that TV broadcasts of all kinds are protected by copyright,” said Simon Twiston Davies, CEO of CASBAA.

“This outcome, in particular, delivers a clear message to the food and beverage industry that copyright must be determinedly respected at all times. Without such support the entire media and entertainment industry – a vital pillar of Hong Kong’s economy – is under threat.”

In a separate Hong Kong High Court action in July, the bars argued that FIFA and Cable TV had failed to supply sufficient evidence that the cable operator held the exclusive rights for the distribution of the World Cup football matches. The Judge threw out the defending argument, saying the bars had provided no reason to doubt the licensing arrangements.

“Pay-TV is a major instrument for sports development and we are delighted to see Hong Kong taking the lead in protecting the rights of those who make big investments in the Asia Pacific,” said David Murray, Senior Legal Counsel of FIFA.

Cable TV further noted that pay-TV piracy of all kinds undermines the business model for creating and distributing high-value television programming, not only for sports but also for dramas and even news content. “Without strong copyright legislation and the support of the courts, the entire communications industry will be unable to grow in Hong Kong. We very much welcome the results of these on-going cases,” said Garmen Chan, Vice President, External Affairs of Cable TV.

Meanwhile, CASBAA said the industry remains committed to tracking down and prosecuting the suppliers of illegal pay-TV equipment in Hong Kong. While the unauthorized display of pay-TV services in public venues for commercial gain is of the greatest concern to the industry, the traders in illegal decoders are at the head of the supply chain and, as in previous cases, “will not be allowed to operate without sanction”. In earlier legal actions CASBAA and its members won high profile cases against such traders in the High Court.

SARFT CASBAA Training in Beijing

Aug 9 – On August 8/9 in Beijing CASBAA presented training sessions to 150 officials drawn from the State Administration of Radio Film and Television (SARFT), leading pay-TV operators and new media providers from 32 Chinese provinces. During the SARFT event Vice Minster Tian Jin thanked CASBAA for its support on the briefings on mobile TV, IPTV, Internet broadcasting and the global regulatory environment.

CASBAA supports Singapore call

Hong Kong, July 30, 2007 – The Cable & Satellite Broadcasting Association of Asia (CASBAA) today applauded a decision by Singapore’s Minister for Information, Communication and the Arts (MICA), Lee Boon Yang, to refrain from intervention in exclusive carriage agreements in Singapore’s pay-TV industry.

“CASBAA welcomes the Singapore decision,” said Simon Twiston Davies, CEO of CASBAA. “The right to contract between parties for premium and exclusive content is part of the bedrock of the global pay-TV industry.

“The MICA decision is the way ahead for digital media, as new channels of delivery open new vistas for consumers.”

Twiston Davies noted that the recent launch of SingTel’s long-awaited IPTV service has resulted in the announcement of several additional pay-TV channel offerings for Singapore consumers.

Meanwhile, statistics from Hong Kong – where exclusive carriage agreements are permitted and four pay-TV providers compete for consumer dollars – also demonstrate a rapid increase in the range of content on offer to consumers. International “best practice” always encourages exclusivity, permitting pay-TV content providers and platform operators to differentiate their products.

“Exclusive content is an important competitive tool and Singapore is poised to see similar growth to that experienced in Hong Kong,” said Twiston Davies.

In making his decision, Minister Lee supported a ruling by the Media Development Authority (MDA) made after three years of study on the impact of exclusive carriage contracts.

“Government intervention in contractual arrangements can restrict this important competitive feature, resulting in less investment and – in the long run – less consumer choice,” said Twiston Davies. “We hope to see similar policy decisions to that taken in Singapore implemented in other Asian countries.”

CASBAA membership still growing

Hong Kong, July 20, 2007 – The Cable & Satellite Broadcasting Association of Asia (CASBAA) has announced two new Patron and four Corporate Members of the Association for the second half of 2007.

The two new Patrons are based in the US: global video transmission specialist Genesis Networks and mobile technology supplier Qualcomm MediaFLO Technologies.

Meanwhile, another four organisations have signed as Corporate Members, including law firm Minter Ellison, with Asia Pacific headquarters in Hong Kong, Indonesian DTH platform PT Direct Vision, Singapore-based satellite services provider SAT-GE and Mumbai and Delhi-based news media and entertainment company Television Eighteen.

“It is exciting to see the continuous growth of our membership, reflecting strong global confidence in the Asia Pacific market,” said Simon Twiston Davies, the CEO of CASBAA.

In April six Corporate Members also joined CASBAA, including Tata Sky of India.

CASBAA now represents the interests of some 125 member companies from across 14 Asia Pacific markets, covering multiple sectors including cable, satellite, broadband and mobile TV content suppliers and platforms, as well as equipment vendors.

Upcoming programs for the rest of this year include the CASBAA Sports TV Forum in Beijing on August 24th and the CASBAA Convention 2007 in Hong Kong on October 30th – November 2nd.

CASBAA Sports TV Forum on August 24th

Hong Kong, July 16, 2007 – China International Television Corporation (CITVC) and the Cable & Satellite Broadcasting Association of Asia (CASBAA) are pleased to detail the re-scheduled International Sports Television Forum 2007 for Friday August 24th at the Shangri-La Hotel, Beijing, China.

The Forum is hosted by the State Administration of Radio, Film & Television (SARFT) and co-organized by CASBAA with CITVC, the commercial arm of the state broadcaster CCTV.

The Forum 2007 will see a new format for the program: “This year will offer even more debate and discussion about the pertinent issues surrounding sport on television as well as in the wider sports arena,” said Kevin Jennings, Events Director of CASBAA.

In addition, on August 23rd the conference organizers are inviting VIPs and special guests to tour some of the completed Olympic installations in a sneak preview of sites now being prepared for the 2008 Beijing Games.

“The Forum has been developed as a key component within a strategy of informing and exchanging information with the international community on the development of China’s sports television industry,” said Marcel Fenez, the Chairman of CASBAA. “Over 400 international executive-level officials and China-based TV professionals gathered at the event last year, which was a huge success. The Forum this year will certainly bring more valuable insights to benefit the industry and economic development in China.”

Topics for discussion during the Forum include an in-depth analysis of how companies can expand their sports brand in China, with particular emphasis placed on football clubs in the English Premier League.

The Forum will also examine how companies can build market share by partnering with major sports events while looking at sports in the broadcasting value chain.

Among other issues, panels will be looking at ways to invest in the China market, gains and losses from previous Olympics, and the synergies between sports leagues and pay TV.

Participants will include CCTV, Beijing Olympic Broadcasting (BoB), the Beijing Olympic Committee Organizing Group (BOCOG) and representatives of national Chinese and European sports bodies, along with global sports TV networks and sports management teams. Other speakers and delegates will be drawn from the wireless, broadband and HDTV sectors.

IPR at the heart of Vietnam pay-TV growth

Ho Chi Minh City, July 11, 2007 – The Cable & Satellite Broadcasting Association of Asia (CASBAA) today reaffirmed regional television industry support for the remarkable growth of the Vietnam pay-TV industry – recently at more than 50% per year. A high-level meeting of industry executives in Ho Chi Minh City praised the Government of Vietnam and domestic pay-TV operators for creating one of the most vibrant markets in Asia.

According to CASBAA, Vietnam has made important strides towards adhering to international standards for the protection of Intellectual Property Rights (IPR) for broadcasters of all kinds. During a working seminar on pay-TV services for 120 officials and industry executives, CASBAA noted the favorable trend, which has heightened the interest of foreign investors in Vietnam. The seminar, entitled “Growing Pay-TV in Vietnam: Enhancing Revenues and Protecting Contents,” was co-organized by CASBAA and the Copyright Office of Vietnam.

However, the industry Association, which represents more than 120 companies from across the region, also warned that a formally structured, fully licensed, competitive marketplace must be put in place in order to support digital infrastructure and to underpin Vietnam’s economically vital communications market.

“CASBAA and its member organizations are eager to help Vietnamese companies to build a viable pay-television industry to meet the needs of Vietnamese consumers and contribute to the country’s development goals,” said Simon Twiston Davies, the CEO of CASBAA. “But the deployment of enforceable (and enforced) IPR and transparent licensing regimes is essential if today’s remarkable growth pattern is to be sustained.”

With approximately 1 million legitimate subscribers to pay-TV systems across the country, Vietnam also notably features more than 2.5 million unauthorized (pirated) pay-TV subscribers to cable, satellite and digital terrestrial systems in Ho Chi Minh, Hanoi, Danang and the other fast developing cities.

“The tolerance of widespread pay-TV signal theft sends a very negative message, even as Vietnam continues to benefit from its accession to the World Trade Organization and looks forward to the launch of the exciting VinaSat project in 2008,” said Mr Twiston Davies at the conclusion of the meeting in Ho Chi Minh City. The success of this project, and many others in Vietnam, will depend on continuing progress toward creating a positive environment for growth of the legitimate industry.
