Indian Copyright Enforcement Orders On The Rise

Jully 11, 2012 – When Viacom 18 Motion Pictures, the producers of Gangs of Wasseypur, got an interim injunction called a “John Doe order” from the Bombay High Court to prevent their film from being illegally shown on cable TV, DVD format, or online, the film’s director, Anurag Kashyap, tweeted, “What is this John Doe order?”

Others may be equally baffled. For though Bollywood’s film producers are queuing up to get John Doe orders from the courts, not many are aware what the injunction is all about.

John Doe injunctions — common in countries like the UK, the US, Canada and Australia, where they are applied to intellectual property rights matters — have been used earlier in India in trademark and copyright infringement cases.

I&B cautions MSOs over digitisation data

New Delhi, July 7 (PTI): The ministry of Information & Broadcasting has come out with a new rule under which Multi System Operators (MSOs) and Local Cable Operators (LCOs) can lose their license if they fail to provide data on Digitisation sought by the government.

The I&B ministry on Saturday said that this new rule had been framed as the MSOs and LCOs were not providing consistent information about installation of Set Top Boxes (STBs), an aspect crucial for its drive to Digitalise the cable sector. “While assessing the preparedness of the Digital Addressable System (DAS) in four metros, the Ministry has come across numerous inconsistencies of data provided by the service providers, particularly MSOs, in regard to inventory position of STB and its deployment,” the I&B ministry said.

“In view of this, the Ministry has decided to amend the Cable Television Network Rules, 1995 making it obligatory for every cable operator and multi-system operator (MSO) to provide correct and timely information to the ministry as and when it is sought for,” the ministry added.

Authorities will launch frantic efforts to help almost 7 million satellite TV households watch the Olympic Games, who might otherwise miss out on the quadrennial event beginning in London this month.

July 6, 2012 – Fears of a repeat of the Euro 2012 controversy surfaced yesterday as the Television Pool of Thailand (TV Pool) and the National Broadcasting Television (former Channel 11) have the rights to broadcast this world sports event via terrestrial broadcasting only.

This will spark another heated controversy over copyrighted sports events after satellite TV households and TrueVisions subscribers were left with a blank screen during the recent Euro soccer tournaments due to copyright restriction by the rights holder. However, TrueVisions subscribers will be able to watch the Olympics.

Yesterday, TV Pool members held talks with the National Broadcasting and Telecommunications Commission (NBTC) along with representatives from major broadcasters at the NBTC’s roundtable discussion to find a solution to the non-availability of upcoming copyrighted sports tournaments, including the Olympics and the Fifa World Cup.

China new campaign against online piracy

July 5, 2012 – The Chinese government has launched a new campaign targeting rampant online piracy through enhanced supervision and inter-agency coordination, according to a statement from the four ministry-level departments.

The four-month campaign will highlight supervision over both content providers and online storage and search engine services, as well as e-commerce platforms.

SARFT clarifies IPTV regs

July 4, 2012 – SARFT recently released an official Notification of IPTV Broadcast Platform Construction to regulate IPTV operators. It clarified that all IPTV content broadcast platforms, including state and provincial level broadcast platforms, and companies running IPTV business, shall gain from SARFT the license for online audio and video program broadcast before they can start business.

Indian digitisation picks up

July 3, 2012 – According to data released by India’s Ministry of Information & Broadcasting (MIB), cable TV digitisation is expected to pick up.

The deadline for the digitisation of cable TV services in four cities – Delhi, Chennai, Mumbai and Kolkata – was revised recently by the MIB. The implementation of the new Cable Television Networks (Amendment) Rules was supposed to be done by 30 June 2012.

Europe rejects Hollywood anti-piracy treaty

The European Parliament votes overwhelmingly to dump Hollywood-backed anti-piracy treaty.

BERLIN (July 4, 2012) – The European Parliament has voted overwhelmingly to reject the ACTA treaty designed to crack down on online piracy and other intellectual property theft worldwide.

In a vote of 478 against to just 39 in favor, with 149 abstentions, EU politicians killed ACTA, responding to critics who complained the treaty had been negotiated in secret and could be used to violate freedom of expression rights across Europe.

Supporters of the treaty had suggested postponing the crucial voting at the Parliament plenary on Wednesday, but members of the parliament decided not to delay the decision any further.

228m boom in global STBs

July 3, 2012 – Following several years of healthy growth, demand for set top boxes continues to climb this year, on track to reach 228 million units shipped globally, according to research from Futuresource Consulting. However, as demand from maturing pay-TV markets like North America and Western Europe begins to slow, the market will start to see moderate decline over the next few years.

Despite this, STBs will remain a core component of the pay-TV industry’s service proposition as operators utilise the box to exploit existing services and look beyond the delivery of video to improve subscriber retention and grow revenues.

Leading manufacturers are launching a new generation of STBs labelled as media gateways or smart boxes. This new generation of STBs offers features such as transcoding, wireless routing, multi-platform content management, media distribution and multi-room delivery.

Live TV piracy growing 61%

July 3, 2012 – Live TV gateways represent the fastest growing segment of online piracy, according to a joint study commissioned by Google and British rights organization PRS for Music.

BAE Systems Detica identified six distinct business models behind online copyright infringement, with each one having clear commercial purposes. The other five segments are; the P2P Community; Subscription Community; Music Transaction; Rewarded Freemium and Embedded Streaming.

Commenting on the report Google’s Theo Bertram, a former Downing Street adviser said: “Our research shows there are many different business models for online infringement which can be tackled if we work together. The evidence suggests that one of the most effective ways to do this is to follow the money, targeting the advertisers who choose to make money from these sites and working with payment providers to ensure they know where their services are being used.”

Global digital TV homes to double between 2011 and 2017, passing billion barrier

July 3, 2012 – A new report from Digital TV Research is predicting that global digital TV penetration will climb from 48.6% at the end of 2011 to 86.7% by 2017 leading to a total of 1.323 billion digital TV homes.

The Digital TV World Household Forecasts report states that digital cable will be the most popular TV platform by end-2017, accounting for just under a third (32.4%) of the world’s TV households, with analogue cable still serving 4.1% of TV homes. Pay digital DTH penetration will be 14.4%, with FTA digital DTH accounting for 9.1%. Pay IPTV penetration will climb to 10.8%, up from only 3.7% at end-2011. About 16.7% of homes will be primary FTA DTT at end-2016, with 0.9% pay DTT. Analogue terrestrial TV will be taken by 9.2% of the world’s TV households, down from 31.8% at end-2011.

The analyst also estimates that 259 million of the 648 million digital TV homes to be added between 2011 and 2017 will come from digital cable. Furthermore there will 174 million new primary FTA DTT homes; 5 million more pay-DTT homes; an extra 114 million pay-IPTV homes; and pay-DTH and FTA DTH homes up 66 million and 31 million respectively.
